Parent-Indemnitor(s) agrees to and shall indemnify and hold harmless SOPOA (including its Directors, officers, agents, employees, and successors, in whatever form — association — city or otherwise) from and against any and all claims, losses, damages, causes of action, suits, and liability of every kind, including all expenses of litigation, court costs, and attorney’s fees, for injury to or death of any person, or for damage to any property, arising out of or in connection with the operation of any unlicensed All Terrain Vehicle, Utility Vehicle, Go-Cart or Golf Cart, whether of the 2, 3, or 4 wheeled variety, in Scenic Oaks, where such injuries, death, or damages, are caused by S.O.P.O.A.’s sole negligence or the joint negligence of S.O.P.O.A. and any other person or entity. It is the expressed intention that the indemnity provided for is to indemnify and protect S.O.P.O.A. from the consequences of its (their) own negligence, whether that negligence is the sole or concurring cause of the injury, death, or damage. Further, indemnitor(s) agrees to see that all rules and controls of S.O.P.O.A. will be followed by the operator(s) and riders on such vehicles in Scenic Oaks, indemnitor(s) covenants not to sue any of the above for any such injury, damage, or death, and agrees to assume all the risks (of which there are many) in the operation of such vehicle(s) in Scenic Oaks.
